Terms of Service

Harry & Rosie Meal Plans — From Young to Old

These Terms govern your use of the Harry & Rosie Meal Plans web application and related services (the “Service”) provided by Harry & Rosie Pty Ltd ABN 39 697 542 457 (“we”, “us”, “our”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. What the Service is — and what it is not

The Service is a digital recipe cookbook for families. It contains:

       Recipes and family-style meal plans.

       Optional filtering by ingredients you’ve asked to avoid.

       AI-assisted features for finding recipes, suggesting cooking-stage variations and matching pantry ingredients to recipes.

       A community section where users may submit their own recipes.

The Service is not a source of medical, nutritional, dietetic, allergy, feeding, paediatric, developmental or therapeutic advice. It is not a substitute for professional health advice and must not be used as one. See section 5.

2. Eligibility and account registration

You must be at least 18 years old to create an account. When you create an account, you agree to provide accurate information and to keep it up to date. You are responsible for keeping your login credentials confidential and for any activity on your account. Notify us immediately of any unauthorised access via hello@harryandrosie.com.au.

3. Free trial and subscriptions

We offer a 14-day free trial to new users. After the trial period ends, ongoing access to subscriber-only content requires an active paid subscription, purchased through our Shopify store at harryandrosie.com.au.

Subscriptions auto-renew on the same period you signed up for (monthly or annual). At least three (3) days before each renewal, we will send a reminder email to the address on your account so you can decide whether to cancel before being charged. You can cancel at any time through your Shopify account.

4. Subscription cancellation, refunds, and your consumer rights

You may cancel your subscription at any time through your Shopify account; cancellation takes effect at the end of the current billing period.

Nothing in these Terms removes your rights under the Australian Consumer Law (ACL) — including the consumer guarantees in Schedule 2 to the Competition and Consumer Act 2010 (Cth). If the Service is faulty, materially misleading, or fails to meet a consumer guarantee, you may be entitled to a refund, repair, replacement or other remedy under the ACL. Where the failure is major, you have the right to choose between a refund or a replacement of the relevant services; where the failure is minor, we may choose the appropriate remedy. Outside of these ACL entitlements, we do not offer pro-rata refunds for partial billing periods.

5. General information only — not medical, nutritional or feeding advice

The Service is a cookbook. It is not medical, nutritional, dietetic, allergy or feeding advice and must not be relied on as a substitute for professional advice.

The recipes, ingredient-avoidance filters, suggested variations and AI-generated responses are for general culinary inspiration only. They do not constitute medical, paediatric, nutritional, dietetic or allergy advice. They are not designed to diagnose, treat, cure or prevent any condition, and you must not rely on them to make health decisions for yourself or your child.

You should always consult your GP, an accredited practising dietitian, paediatric dietitian, paediatrician, allergist or other qualified health professional before:

       Introducing solid foods to a baby.

       Introducing any common allergen (including peanut, tree nuts, egg, dairy, wheat, soy, fish, shellfish and sesame).

       Making decisions about a child’s diet, nutrition, growth, feeding plan, or about managing any actual or suspected allergy, intolerance or medical condition.

       Acting on anything the Service or its AI features have told you.

The “foods to avoid” filter is a recipe-selection convenience that hides recipes containing ingredients you’ve ticked. It does not guarantee any recipe is free of any allergen or contaminant. Cross-contamination occurs in commercial food supply chains and in home kitchens; always read ingredient labels on packaged products, take appropriate care when introducing new foods, and seek immediate emergency medical attention if a child shows any signs of an allergic reaction.

6. AI-generated content

The Service uses third-party large language models from Anthropic to power its cooking-assist features. The AI is instructed to answer only recipe, ingredient-substitution and cooking-technique questions, and to decline anything resembling a medical, nutritional, allergy, feeding-safety or developmental question by directing you to a medical professional.

AI responses can still be inaccurate, incomplete or out of date. We make no warranty as to the accuracy of AI-generated content. Do not rely on it for medical, nutritional, allergy or feeding decisions.

7. Community recipes

Recipes submitted to the community section are user-generated content. We do not verify, endorse or take responsibility for the accuracy, safety or suitability of community recipes. By submitting a community recipe, you grant us a non-exclusive, royalty-free licence to display it within the Service.

8. Use of content

All non-community content provided by us is owned by Harry & Rosie Pty Ltd or licensed to us. You may use it for personal, non-commercial purposes only. You may not reproduce, redistribute, resell or republish content in any form without our prior written consent.

9. Acceptable use

You agree not to:

       Use the Service for any unlawful purpose.

       Submit harmful, offensive, discriminatory or misleading content to the community section.

       Attempt to access, scrape or extract data belonging to other users.

       Reverse-engineer, decompile or interfere with the Service.

       Resell, sublicense or rent the Service to any third party.

       Use automated tools (bots, scrapers) to access the Service.

       Misrepresent your identity or your relationship to a child.

10. Service availability

We aim to keep the Service running but cannot guarantee uninterrupted access. We may suspend, modify or discontinue any part of the Service at any time, with reasonable notice where practicable. We will not be liable for any loss arising from downtime, errors, data loss or feature changes, except as required by the Australian Consumer Law.

11. Liability and Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that you have under the Australian Consumer Law and which by law cannot be excluded, restricted or modified. The provisions of these Terms apply only to the extent permitted by law.

Subject to the above, and to the maximum extent permitted by law:

       We exclude all implied warranties beyond the consumer guarantees that cannot be excluded.

       We are not liable for any indirect, incidental, consequential or special losses arising from your use of the Service.

       Our total aggregate liability to you for any claim arising out of these Terms or the Service is limited to the amount you have paid us in the 12 months preceding the claim, or, where a consumer guarantee under the Australian Consumer Law applies and the law permits us to limit liability, the supply of the services again or the cost of having the services supplied again.

12. Your responsibility for health decisions

You are solely responsible for assessing whether any recipe, ingredient or suggestion provided by the Service is appropriate for you, your child or anyone in your household. To the extent permitted by law, you agree to indemnify us against any third-party claim arising from your misuse of the Service or your breach of these Terms. This indemnity does not extend to any loss caused by our own negligence, fraud or misconduct, or which by law cannot be the subject of such an indemnity.

13. Privacy

Our handling of personal information is described in our Privacy Policy. By using the Service you agree to the collection and use of your personal information as described there.

14. Changes to these Terms

We may update these Terms from time to time. We will notify you of material changes by email or in-app notice at least 14 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

15. Governing law

These Terms are governed by the laws of Western Australia, Australia. The parties submit to the non-exclusive jurisdiction of the courts of Western Australia for any dispute arising out of or in connection with these Terms.
